These Terms & Conditions (“Terms”) govern your access to and use of the FirstServe marketing website and the FirstServe application (together, the “Service”) provided by FirstServe (“FirstServe,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

FirstServe provides white-labeled management software to racquet and country clubs (each, a “Club”). Access to the application is provided through a Club. Your Club may set additional rules for booking, billing, programs, and conduct that apply to your use of its app.

Accounts & acceptable use

• You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
• You agree to provide accurate information and to use the Service only for lawful purposes and in accordance with your Club’s rules.
• You may not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or to other users’ data.

Text messaging (SMS)

If you opt in to text (SMS) alerts, you consent to receive automated account, transactional, and reminder messages from your Club through FirstServe. Message frequency varies, and message and data rates may apply. You can opt out at any time by replying STOP, or by disabling SMS alerts in your account profile; reply HELP for help. Our handling of phone numbers and consent is described in our Privacy Policy.

Payments

Where a Club enables payments, charges (such as membership dues, program fees, court fees, or store purchases) are handled through the Club and its payment processor and are subject to the Club’s policies. FirstServe is not a party to transactions between you and your Club.

Intellectual property

The Service, including its software, design, and content (excluding Club and user data), is owned by FirstServe and protected by applicable law. Club branding remains the property of the respective Club.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, FirstServe will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
